02 Apr Appeal Allowed for Development Within Listed Medieval Moat
Consilio were able to successfully achieve planing permission for a substantial ancillary building within the setting of a listed moat, at appeal.
The application site was littered with constraints being sited within the Green Belt, adjacent a Grade II Listed Building and within the curtilage of a Listed Moat. The proposed outbuilding was of a substantial size (approx 85 sq.m) and sought to replace an existing building that had become dilapidated. A formal application was submitted and prepared between the Consilio planning and design team to the London Borough of Hillingdon. The Council failed to issue a decision during the statutory 8 weeks and Consilio were instructed by the landowner to appeal against non-determination.
Our planning team were able to demonstrate to the Inspector that the proposed building would not be materially larger then that it seeks to replace and as such, would not materially conflict with the NPPF (2018). The Inspector agreed with the grounds of appeal and felt the building was an improvement to the setting of the Green Belt when compared to the existing building. Similarly, the Inspector agreed with our statement which concluded that the building would not impact the setting of the two ‘Designated Heritage Assets’.
The appeal was concluded with the Inspector agreeing with Consilio that the effective use of conditions would mitigate any concerns relating to the building organically evolving into a separate unit of accommodation.
A favorable outcome to this application and another appeal decision that leaves Consilio at the forefront of residential planning appeals.
